A 92 year old Kansas City man died from eating a contaminated cantaloupe. The lawsuit named the Colorado grower Jensen Farms and distributor Frontera Produce in federal court claiming the cantaloupe was the cause of death. The suit was filed on behalf of the decedent's son.
So far, there have been 146 cases nationwide of a bacterial infection called listeriosis; thirty deaths and one miscarriage were reported.
Schwarz developed listeriosis in September, after eating the cantaloupe traced to Jensen Farms. As a result, he spent five weeks in the hospital and then time in a nursing home when his lawsuit was filed in October. Schwarz died on Dec. 18.
